Terms of Service
1. Scope
These Terms of Service govern the use of the website SingMyName4.me (hereinafter “the Service”), operated by wavepoint GmbH & Co. KG, Bonner Str. 12, 51379 Leverkusen, Germany (hereinafter “we” or “the Provider”).
By placing an order, you agree to these Terms of Service.
2. Service Description
SingMyName4.me offers AI-generated personalized songs. The customer selects an occasion, music style, and provides a recipient name. Based on this input, two lyric variants and two song versions are generated using artificial intelligence. The customer selects their preferred version.
The final product is a personalized MP3 song file and a shareable link.
3. Contract Formation
The presentation of products on the website does not constitute a binding offer. By completing the order and payment process, the customer submits a binding offer. The contract is formed when we confirm the order by delivering the generated song.
4. Prices & Payment
All prices are listed in Euros (€) and include applicable VAT. Payment is processed securely via Stripe. We accept the payment methods displayed during checkout.
The price for one personalized song is €9.99.
5. Delivery
After successful payment, the song creation process begins automatically. The customer receives two lyric variants to choose from. After selection, two song versions are generated. The entire process typically takes a few minutes.
The finished song is made available as an MP3 download and via a shareable link sent to the customer’s email address.
6. Right of Withdrawal
Since personalized songs are custom-made digital products created specifically for the customer, the right of withdrawal does not apply once the song creation process has begun, in accordance with §356 (5) BGB (German Civil Code). By starting the order process and confirming payment, the customer expressly consents to the immediate execution of the contract and acknowledges the loss of the right of withdrawal.
7. Intellectual Property & Usage Rights
Upon full payment, the customer receives a non-exclusive, perpetual, worldwide license to use the personalized song for private, non-commercial purposes. This includes:
- Personal listening and sharing with family and friends
- Sharing via the provided share link
- Playing at private events (birthdays, weddings, etc.)
Commercial use, redistribution, resale, or public broadcasting of the song is not permitted without prior written consent from the Provider.
8. AI-Generated Content
All songs are generated using artificial intelligence. While we strive for high quality, we do not guarantee that the output will meet specific artistic expectations. The nature of AI generation means results may vary. The customer is offered two variants to choose from to ensure satisfaction.
9. Liability
The Provider is liable without limitation for damages caused by intent or gross negligence. For slight negligence, liability is limited to foreseeable, typically occurring damages and only in cases of breach of essential contractual obligations.
The Provider is not liable for temporary unavailability of the service due to maintenance, technical issues, or force majeure.
10. Data Protection
Personal data is processed in accordance with our Privacy Policy. By using the Service, the customer acknowledges our data processing practices.
11. Applicable Law & Jurisdiction
These Terms of Service are governed by the laws of the Federal Republic of Germany. If the customer is a consumer within the EU, mandatory consumer protection laws of their country of residence also apply.
Place of jurisdiction for all disputes arising from or in connection with these Terms is Cologne (Köln), Germany, unless a different mandatory legal venue applies.
12. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. Changes will be published on this page. The version applicable at the time of order placement governs the contractual relationship.
